can i use my expired h1b while on h4 status

I have an h1b petition approved on nov,2012, but it will soon expire on nov 2013, meanwhile I travelled to USA on H4 status.Now I want join a job , but am unsure wether this expired h1b petition will be useful for me or what other methods can i use to start working?

i have consulted with so many people regarding this but different people have different opinions about it.

Please clear my confusion.

An employer can file a cap exempt petition as change of status from H4 to H1B and on approval you can join employer immediately

The employer would have to file a new H1 outside the quota. Once that is approved, you can start working for the employer.
