sandhya25186 Posted October 19, 2013 Report Share Posted October 19, 2013 I have an h1b petition approved on nov,2012, but it will soon expire on nov 2013, meanwhile I travelled to USA on H4 status.Now I want join a job , but am unsure wether this expired h1b petition will be useful for me or what other methods can i use to start working? i have consulted with so many people regarding this but different people have different opinions about it. Please clear my confusion. An employer can file a cap exempt petition as change of status from H4 to H1B and on approval you can join employer immediately Link to comment
JoeF Posted October 19, 2013 Report Share Posted October 19, 2013 The employer would have to file a new H1 outside the quota. Once that is approved, you can start working for the employer. Link to comment
