H1B extension in the basis of Pending BALCA

Dear friends, 

 

I want to know if i am eligible to file for H1b extension beyond 6 year based on following situation. 

 

-5th year on H1B started in october 2013. 

-Labor certification filed in jan 2012

-Docketed in Balca in Jan 2013

-Letter of intent to proceed sent to Balca on April 2013

-Current  status is still pending

 

-company is preparing to file new perm. 

 

As per rule of pending labor certification more than 365 days , can i file for h1b extension beyond 6 year right now?

 

Your help will be greatly appreciated.
