tapout Posted October 14, 2013 Report Posted October 14, 2013 Hi, I got my H1B from Client 'A'(Virginia State) in 2012 Now i moved to Client 'B'(North Carolina) Though there is no Material Change in my Roles & responsibilities (http://www.murthy.com/2012/09/07/h1b-amendment-requirement-for-change-in-job-location/) My Question : Do i need to do my H1b Amendment ? If i do Amendment, what are the next steps to proceed ? As i got scheduled for my Visa Interview in Vancouver on November 12th. Thanks.
JoeF Posted October 14, 2013 Report Posted October 14, 2013 The LCA and H1 needs to be amended. There is a material change, the client change.
Scboy Posted October 14, 2013 Report Posted October 14, 2013 When the H-1B worker is assigned to a location in an area of employment not listed on the original LCA. A new labor condition application is required by the DOL.

You need H1 amendment. Their is change in your client's name and also work location, this is nothing but material change since this information is currently not mentioned in your H1.
