Adi120938 Posted October 12, 2013 Report Share Posted October 12, 2013 I was arrested for shop lifting more than a year ago. Finger prints were taken. I did not plead guilty and the case was later dismissed citing 'no offense was in fact committed' and 'no probable cause for filling charges'. The case was later expunged. I received my finger prints that were taken during the arrest. I then applied for my H1B while in United States and got the petition approved. I am now planning to go to India to get my H1B visa stamp. How will the shop lifting case affect my visa chances? What can I do to make my case strong ? Please share experiences. Attorney_23 Posted October 14, 2013 Report Share Posted October 14, 2013 The arrest will have to be disclosed. However, if the charges were completely dismissed based upon lack of evidence, this typically would not prevent you from obtaining a visa. Link to comment

Carry all your court documents with you and be absolutely honest in your responses to interview questions would be my suggestion. Consult an immigration lawyer to be sure. Link to comment
