zombie06 Posted October 11, 2013 Report Posted October 11, 2013 Hi My employer terminated my employment in 2nd week of Sep. He owes me 2 pay checks (full time employee working on employer's business site) and has clearly refused to pay. Now after termination , I got an email from USCIS thru alert setup that my eac on previously approved petition has been REVOKED. Can I recover my pay checks from the employer? I was a FTE at the time of termination and have copies of pay stubs for the pay periods in question. I have filed a complain with local DOL office but it has been delayed because of Govt. shutdown. Any other options to have this matter escalated? Overall, in between all the above, got my H1-B transferred before the revocation and am working as a sub-contractor with a big client. Thanks in advance.
omshiv Posted October 11, 2013 Report Posted October 11, 2013 yah..good you have complained to the DOL..but it wont be like they will make your employer pay the very next day of the complaint...it will take some time to investigate but ultimately you'll win the battle.
