CAP GAP ended.. H1B Denied.... and F1 status COMPLETED

Hi,

 

Here is my current status

 

Masters in CS from September 2008 to  September 2010.

OPT - November 2010 to November 2011

STEM Extension - November 2011 to April 1,2013

CAP GAP- April 2,2013 to September 30,2013.

H1B Applied - April 1,2013

H1b Decision Denial - October 7,2013( Waiting for denial notice from USCIS).

 

As my F1 status got COMPLETED , i came to know that i need to apply for Re-Instatement for regaining my F1 status from USCIS.

 

I got admission to SEVP certified school and the program begins in January 2014.

 

What are the options i have now??

1. Chances of Re instatement approval from USCIS.

2. How much time will it take for Re instatement.

3.Am i in Grace period now ?  can i ask DSO for Data Fix as my OPT ended on September 30,2013.

 

I didnt see my case scenarios online .... please need suggestions from you.

Hi,

 

As i mentioned in my previous post  about my H1b Denial.

Until now ( its been 18 days) since the denial decision updated on USCIS website have not received my Denial Notice of My H1b case.

 

How can i file Motion to Reopen or Reconsider without Denial Notice.

Our Attorney called the USCIS , as usual they gave a Service Request Ticket Number and wait for 30 days ie., Nov 22,2013.

 

What are the options now for me?

 

I'm a F1 status Completed Student ,got an admission from an accredited University will file for F1 Reinstatement Next week.

How can i file my MTR if i receive Notice after November 7,2013.

 

 

Please guide me on this

You have 60 days grace period (from the date of H1B denial) to leave US

Then, with a new F1 visa you can enter US later for your program beginning in Jan 2014.

SEVP certified doesn't mean anything. Even TVU was SEVP certified.

 

What's important is if the school is ACCREDITED!

A bunch of non-accredited diploma mills always shout "we are SEVP certified", but keep the information that they are not accredited somewhere in the fine print.

Stay away from any school that is not accredited.

Consult an attorney dude.

You have already filed for H1, so if you apply for F1 how will you convince vo that you won't file for H1 again??
