Can i extend for 7th year in H1B when PERM is in denial and appealed

Hi,

 

I applied for extension based on the below scenario. I didn't get the docketing number yet. but the employer has applied for extension. I was wondering if i can get the extension since my case still in processing. 

 

applied for PERM - Dec 2011

First audit - march 2012

Replied - April 2012

Denial - August 2012

Replied - Sep 2012 (when replying to the denial, should it be replied to both the CO and BALCA?)

H1 expired - Sep 2013

Still waiting on the docketing number

 

How long would you think it would take to get the Docketing number? Please any suggestion/information on this issue would help.

Is this an appearance or an MTR?

My apologize that I don't know what an appearance is compared to MTR.

 

But when i spoke to the Attorney, he said that he has re-appealed the denial in Sep 2012. But i still didn't get the docketing number from BALCA.
