Vbr3650 Posted October 1, 2013 Report Share Posted October 1, 2013 My spouse, who is on H4, is travelling to India now and she will be back 1st week of Dec 2013. Her visa expires Jan 30 2014. I am in my 6th year and my labor is pending. accordingly so, i don't have H1 extension beyond Jan 30 2014. when my wife returns to USA in 1st week of Dec, would it be a problem at port of entry because she has visa validity until Jan 2014 and there is no extension for associated petition(h1) holder,me in this case, beyond Jan 30th 2014? please clarify. Just in case if you were unaware..you may file your I-140 in PP once Labor gets approved and then file for H1B extension for another 3 yrs. Good luck. Link to comment
