F2A Filed 130 and 485 concurrently, received RFE on 485 app

Hi

As F2A was current i applied for the following:

i485

i130

i131

i765 

with a priority date of 8/28

 

for 485 - i got fingerprinting done too. i got an RFE last week, which my lawyer called and explained that 130 and 485 cannot be filed concurrently and he didn't know about it.

 

i was reading some forums which said that select Option h with filing I-130 concurrently

 

is this true? anybody facing similar situation. Pls advise as i need to get an EAD ASAP

The F2A Spouse of Lawful Permanent Resident category was current in August and September. This permitted concurrent I-130 and I-485 filings for many spouses of lawful permanent residents legally present in the United States in lawful nonimmigrant status.
