After my research has ended i wil like to apply for residency on a H1b visa. Under what provisions can you get a waiver ( 2 year home stay rule (212e)) for a J research Visa? Is IGA a viable option? Kindly reply. Any one with some personal experiance are also welcome Thanks
futureeb2 Posted October 1, 2013 Report Posted October 1, 2013 IGA waivers generally apply to residency program J1s. For research J1s, generally all you need is a letter from your home country's government expressing No Objection.
nagarajus Posted November 5, 2013 Report Posted November 5, 2013 I am a research scholar on a J1 visa with 212(e) clause on the visa and want to pursue clincal fellowship in transplant surgery. I want to get a H1 visa for my fellowship as my wife is also on a H1 visa. Is it possible to change the visa without completing the 2 year clause? Is a waiver possible?
