H1B Work permit, Nocap category eligibility

Hi

 

Held two H1B work permits. 

First one: ------- company 01; Jan-08-2007 to Jan-07-2010.

Second one:---- company 02; Feb-13-2008 to Sep-13-2010.

 

left for india on feb-01-2009 before the second H1B expired.

 

Total duration of H1B is 3 years 8 months.

Total duration of H1B usage 3+ years(left for India before the second H1B expired)

 

As of Sep-20-2013 visiting USA on B1/B2.

Now i want to apply for H1B work permit under no cap.

 

The question is, am i eligible for H1B work permit under no cap.

If eligible for H1B under no cap, do i have to apply before October-1st-2013 or is there any other deadline

You are cap exempt. A H1B petition could be filed anytime and on approval you can begin to work.
