nik_1981 Posted September 17, 2013 Report Share Posted September 17, 2013 hello all, i have my i 140 approved in EB3 category in aug 2012 and right now i am on my H1B extention which is valid till oct 2014 based on previous employer's i 140. I got a new emplyer who will start me with new H1B and will do my green card in EB2 category, however he will start me GC process one year after my joining. Is it safe to make a move under this senario? what if my previous emplyer revokes I140 before my GC process with new employer will start, will it affect my new green card process and previous priority date? please advise. rohang Posted September 18, 2013 Report Share Posted September 18, 2013 It will not matter, when you will shift, you will be eligible for 3 yr extension, and when your new employer will start GC processing (after 1yr) , he can port ur original PD. Link to comment
