bhanuteja Posted September 11, 2013 Report Posted September 11, 2013 Hi , i got arrested in Jan 2009 for selling alcohol to minor (TABC) . I did all things they asked me to do and this case is closed on Dec 2009. I did mention this in my H1b stamping(ds 160) also. I contacted a lawyer and asked them to file for expunge. March 2013 they field but there is no response from DA office. Generally how long will this take ?? Does this effect my green Card process?? thanks
JoeF Posted September 12, 2013 Report Posted September 12, 2013 You still have to list this on immigration applications. Nothing is ever expunged for USCIS.
bhanuteja Posted November 13, 2014 Author Report Posted November 13, 2014 Hi, Yes TABC case can't be expunged so they did non-disclosure so that some of the agencies can't see the arrest record. I did mention this in DS 160 form and got my VISA stamped in 2012. Do I need to mention this in I 485 also? Will this effect my GC process? Thanks BhanuTeja
JoeF Posted November 13, 2014 Report Posted November 13, 2014 You need to mention it on ALL immigration forms that require listing arrests/convictions, etc. These things are never expunged or hidden for immigration. Immigration authorities can always see them.
