piesmores Posted September 7, 2013 Report Share Posted September 7, 2013 I have spoken with my lawyer couple of weeks ago, he claimed that he hadn't recieved any withdrawal letter from the immigration office. My case is under Eb3 cateogry, I have been waiting for years but no results. My company had sponsored many employees and their case were a success. Due to the recession, my company had more liability in their balance sheet that failed the quick ratio test, as the result proofs that my company don't have the financial capacity to pay my proffered wage. :( So what I must do to win this case ? My priority date is current, but I got no reply from my lawyer. He rarely answers my calls and have been delaying my case more months. Link to comment
JoeF Posted September 9, 2013 Report Share Posted September 9, 2013 Well, if the company doesn't have the financial means to pay your salary, the case can't go forward. And you also should have gotten a better lawyer. As of for now, it seems the case is over. Link to comment
Attorney_15 Posted October 16, 2013 Report Share Posted October 16, 2013 If a company's plan is to withdraw some I-140 petitions to help meet the ability to pay requirement on an I-140, the I-140 withdrawal letters can generally be included with the I-140 petition filing, instead of waiting for confirmations from USCIS.
