H1 to H4 and back to H1

Hi,

 

I just got let go by my company and my last working day is Sept 13th. And the company lawyer said that I will go immediately out of status. I have an option to convert to H4 as a dependent on my husband's H1b visa. 

1. My question is if I get a job right after I apply for COS what happens?

2. Can I withdraw H4 application?

3. What happens if I get my H1 through premium processing and immediately I get my H4 petition also approved (in that order)?

What your company attorney said is right.

(1) You can apply for premium processing and get approval before your approval of COS to H4

(2) I believe you can.

(3) It will take at least 2.5 months for COS to H4 to get approved in current situation.
