H1B Extension beyond 6 years with I140 approval receipt

Hi,

 

I am going to max out my H1b six years some time in november this year. I have a I140 approval receipt number from previous employer. Will that be enough for getting 3 years extension after first 6 years? I am going to apply for FOIA tomorrow for I410 approval evidence. I am not sure how much time its going to take. Did anyone ever applied with just I140 receipt number?

USCIS does not often approve a post six-year H1B extension without a copy of the I-140 Approval Notice (when that is the basis). Therefore it may be best to wait for the FOIA response prior to filing. If you are getting close to the expiration date, timely file with what you have and ideally prior to issuance of the RFE you will have received the FOIA documents. To discuss this in more detail, it is advisable to speak directly with a qualified U.S. immigration attorney.
