Dldd Posted September 4, 2013 Report Posted September 4, 2013 Hi My H1 was recently extended and I did not happen to travel back to India and get it stamped. My visa has expired but I do have a valid I94 that came with the transfer. I am planning to change employers and can it done on the basis of the I94 or do I need a valid visa with stamping? Also if I happen to get my H1 transferred successfully, will I face issues in my subsequent stamping as my earlier extension was not stamped? Thanks
omshiv Posted September 4, 2013 Report Posted September 4, 2013 you should be good in both scenarios.

Thanks A new employer can file a H1B cap exempt petition with your previously approved I797 document and valid I94. You do not need a visa. You will not face any problem later.
