asvecee201 Posted September 2, 2013 Report Posted September 2, 2013 Hello guys,I have my canada stamping on sep 23rd, 2013 at Vancouver Canada.I have my H1B I797 (H1B premium approved on April 18, 2013) which is going to start on Oct 1, 2013.My OPT extension expired on May19, 2013 ,and i have my cap gap extension(new I20 with dates showing cap gap extension ) provided by my university international advisor till Sep30, 2013.If I get my H1 visa stamped on sep 23rd then H1 will start from OCT1 , but can i work during sep23-sep30 ?Thanks in advance.

vishnu586 Posted September 3, 2013 Report Posted September 3, 2013 I'm not sure ...... but I think it should be fine to work until sep 30, as you will be working in opt (cap gap) status but not H1B.

But, you have to understand that OP will be entering based on H1B and not OPT. So has to wait for H1B start date.

vishnu586 Posted September 4, 2013 Report Posted September 4, 2013 Thanks.....got you....that, our previous visa/status will be cancelled once we enter into some other status(H1B) or It seems that the consulate people will cancel all our previous visa, when we visit the consulate for visa, nevertheless of we get the new visa or not.
