Minors passport reissue in case of expired visa

Hi,

 

Im on L1 which is expired in April 2013, and I 94 is valid till October 15th. My 5 yr old kid's passport is expiring in October and I am applying for re issue with NYC embassy.

 

The website says to provide notarized affidavit of valid visa, and if visa has expired and extension notice is available then NO STATUS affidavit, 7 copies of Nationality Verification form and notarized copies of 2 green cards.

 

It does not say what to do if visa has expired and we are on I 94 ( we have not applied for extension).

 

Please advice asap. Appreciate your reply.

 

I have applied for H1 but its not yet approved, they have asked for RFE.
