I am going back to India without filing an extension and planning to come back after March 2014. Is it possible to file an extension from India though my visa would have expired during that time and can this visa extension be done through Cap exemption even though my organization is a profit based organization. Please help, thanks.

If your earlier H1B petition was subject to cap then a cap exempt H1B petition can be filed by any employer and upon approval with a valid I797 and unexpired H1B visa you can enter US.
