Unused expired h1, same CAP can be used ?

Hi Murthy forum,

I had came to US in July'10 on L2 and had applied H1.Due to some emergency I had to move back to India in Jan '11. After I went back to India my H1 got approved.

I came back to US again in July'13 on H4 and my H1 got expired in Jan'13. I have never used H1. Currently I am looking for a job opportunity, so can I use same H1 CAP? If yes then after filing extension when can I start working? Any employer can file H1 extension or the same employer have to file it.

Any employer can file a H1B cap exempt petition and upon approval you can work
