H1B Cap Exempt?

My H1 petiion was approved in 2009 but change of status was to happen by consular process. I was working on OPT at that time and so I was never on H1 status. I came to India in 2010 and my visa was rejected. My employer revoked my petetion in 2012.

My current company is willing to sponsor for my H1 from India. I would like to know if I will exempted from the H1B cap since I have already been counted once?

Since your H1B petition was approved you are cap exempt.

Is the Cap exempt valid for all kind of employment or only for a non-profit organization.

 

I work for a Indian consultancy company and its profit based, so can I go for extension based on cap exemption?

If you are counted against cap once then you are cap exempt
