Delayed COS from H4 to F1. Please help.

Dear Attorneys

 

I have been a full time student on H4 visa from spring 2013. I have applied for H4 to F1 COS in june 2013 and have not yet received it. I have few questions in this regard:

 

1. My I20 start date : Sep-04-2013, but if F1 arrives later than the start date - is there a problem with this?

 

2. I would have completed 1 academic year of study in Fall 2013, Can i apply for OPT immediately after my F1 visa is approved or is there a wait time.

 

3. In spring 2014 I will register for 1 course only, this will be my final semester. If F1 arrives in spring 2014 will i be in a valid status?

 

4. If i apply for OPT after my course completion and USCIS takes 3-4 months to process it, will i be in status until OPT processing is complete?

I think you need to finish certain number of credits on F1 to be eligible for OPT.

 

You can check/ask same from your UNIV.

In case of H4 to F1, OPT eligibility criteria differs from one school to another school. I think you need to be very careful here and make sure you won't breach any F1 rules.
