EB3 to Eb2 Same employer

Hi,

 

I have been struggling to convince my employer to port my 2007 EB3 to EB2.

 

During this time frame I have got 4 promotions and doubled my salary. I have completed MS online.

 

My employer is saying that they need

 

1. Either have MS and 1 year out side current employer

or

2. Have bachelor degree with 5+ years out side current employer.

 

I have 4+ year exp out side current employer.

 

What I want to know, is this Immigration law or my company policy only? Do I have hope out side?

Firstly you cannot force your employer to port...its their wish.

 

Secondly, although its possible to port EB3 to EB2 working with the same Employer...you'll need a very experienced Attorney for this.
