krish69 Posted August 20, 2013 Report Share Posted August 20, 2013 Hello Friends, I have applied for OPT Ext on July 29th 2013(doc reached) and my inital OPT will expire on this Aug 26th 2013.. So far its been more than 20 days still i haven't received I-797 Notice Of Action from USCIS, I have called USCIS and they said to wait for 30 days, . Experts please give me your valuable suggestions .. Link to comment
rahulpaudel Posted August 20, 2013 Report Share Posted August 20, 2013 You knew already that OPT process takes a long time. Why didn't you think of these stuffs earlier? If you are working right now, stop working I guess, ask for a leave. Else, Find a lawyer or ask with your DSO. Link to comment

livliv Posted August 27, 2013 Report Share Posted August 27, 2013 Do you have evidence that you sent the application well before OPT expiry and that it was delivered well before? As soon as you get the receipt notice, if the receipt date is after your OPT expiry, send a copy of that evidence to them quoting the receipt number and write a cover letter explaining that you applied well before expiry and the fact that USCIS took possession of your application late was beyond your control. The evidence will also be helpful in case of an appeal or MTR. It may not happen, but best be prepared. Link to comment
