hamepal Posted August 18, 2013 Report Share Posted August 18, 2013 Last year my visa status changed from F1 to H1 and I never went to India after the visa status change. In June my employer has started Green Card processing, it is in Labor certification state. Due to some urgency, I have to go to India. Since this will be my first visit after status change I also have to get the H1 visa stamped. I am bit worried about stamping process. In DS-160 form there is one section which asks whether someone has applied for GC for the applicant. What should I fill here? Consider that I fill Yes in this section, will it hurt my chances of H1 stamping? Link to comment
jairichi Posted August 19, 2013 Report Share Posted August 19, 2013 You have to fill NO as I believe only if an I140 is filed it is considered beginning of GC processing. H1B petition is dual intent. Do not worry about it. Link to comment

For a question in DS 160 form (Has anyone ever filed an immigrant petition on your behalf with the USCIS) I answered NO, is this question related to GC petition? will it be a problem? if so can I make any update to the form, if so how can I do that?.
