Dropbox eligibilty

I did my previous stamping in india and got approved for a year on H1b, from dec 2011- dec 2012. So right now, its under 12 months, since my previous visa expired. my employer applied for an H1b extension while i was in US, but got denied. i left the country immediately,and my employer(the same employer) filed a new H1b and the petition and got approved. My question is am I eligible for dropbox?( i did some digging and found out from my attorney that a petition denial is not considered as a visa denial)
