EAD not renewed while I-485 pending.

I just received RFE for pending I 485. I did not renew EAD between 2008-2010. I have continued to work with same employer, and I have been renewing my EADs with no lapse since 2011. What can happen to my case when USCIS finds EAD not renewed for 2 years. It was purely oversight.

Any suggestion would help. Thanks.

So did you work on EAD back then? or where you working on H1B? Just not renewing your EAD (if you were not working thru EAD) would not cause any issues.

My H1 had expired, but  just then I got my EAD in 2007. It expired in 2008, but I continued to work, till 2010. I realized I had to renew my EAD, and USCIS renewed it with out any questions. I have been renewing timely ever since. The RFE letter states, that they need proof of my EAD's since 2007-2013 and I am missing 2 years of EAD's 2008-2010. I have been with the same job, paid all taxes and I am currently employed in the same position as in 2007.

Oops...so basically you worked without Work Authorization from 2008 till 2010...a very big issue for both you and your employer. Just contact Murthy attorney today itself.

 

I wonder how your employer didnt realize this error.
