H1B transfer while the previous petition is in 'initial reveiw' status

Hello,

 

I got laid off on Feb 22, 2013 from company A while working as a full-time. Company B filied my H1B transfer petition under regular processing on Feb 25, 2013 (got a receipt number). Same company B filed for amendment and premium processing (got a new receipt number) on June 15, 2013.

 

Now, both the receipt numbers are in 'initila review'. I have learned that some of the other candidates from the same Company B experiencing very long delays. Company C is now ready to file a new H1B transfer for me.

 

Questions:

 

1. Will I be in status as long as my application is in processing? or Is there a time limit?

2. Can I approach Company C to initiate a new H1B transfer so that I can expect a decision with in two week of file date.

(1) As long as your application is being processed by USCIS and till a final decision is taken you are ok.

 

(2) You can ask company C to initiate with your H1B transfer to be on safer side
