Cap gap and H1 Stamping

Hi, 

 

I am currently on Cap GAP with an approved H1b application.WIth this status can I travel to India in the last week of September and go for stamping in the first week of October. I want to be in India by last week of September to attend a family function.

I was researching about the same thing, what I found that you can get visa stamping(interview) date only 10 days before of I797 starting date. In my case It was Oct 2013, that means I can get interview date after 20th Sept. Since you will enter US in Oct so it will be all fine for you.

I want to correct myself, you can get visa interview date 2-3 month before of I797 date. But you can enter back to US only 10 days before of I797 date.
