H1B Transfer & start date

Hi,

 

Following is my scenario with the Transfer question i have:

 

2011:

Employer A - H1b Approved and Stamped - Valid until Sep 2014

 

2012: Switched Employer

Employer B - I-797 valid until Sep 10 2013

 

Aug 2013

Employer C is ready to hire but start date may get delayed until end of september.

 

 

Question:

1) Employer B has not filed for an extension yet, Would i be out of status from Sep 10 2013 up until Employer C starts processing my transfer ?

 

2) Can employer C initiate the transfer after Sep 10 2013 ? OR Is it to be done prior to Sep 10 2013 ?

(1) As long as employer C gets a receipt number for your H1B petition then you would be considered in status till a final decision is made on your application

 

(2) It is better they start before Sept 10. You could request them for premium processing.
