santsub Posted August 14, 2013 Report Share Posted August 14, 2013 I am currently employed full time (regular) with a big company and I am on my EAD. Have been on EAD since start here. My Priority date is oct 5 2005 but my former employer who filed my GC in 2004 - 05 filed it under EB3 My situation: I have a job offer from X - who is ready to help me upgrade my EB3 to EB2 which means a lot to me but the caveat is that the position is a contract to hire position. if I take this position it will mean 3 + months on contract and then a full time. IF I move from my current job there will be no company supporting me on my EAD or AP What do you guys advice? Can I move like this? will this affect my AOS and or filing for EB2 in future? any help or answer will be highly appreciated. thanks in advance! Link to comment
kalyan_ac Posted August 15, 2013 Report Share Posted August 15, 2013 You can work on EAD for the three months and up until the time they file your Perm/I140 etc. You can always respond with an AC21 if USCIS comes back with a RFE. Just make sure your new employer is ready to give a EVL for invoking the AC21. Link to comment
