RFE on H1 COS from L1B

Need some help on H1 RFE.

 

My L1B visa expired on Nov 2012 & i-94 expired in June 2013. We have applied for L1B extension in May 2013. My H1B is also in process now and got RFE for change of status.

Asking evidence for valid status from June  to October 2013.

 

1. Can I send the L1B receipt notice as evidence of status ? After i-94 expiry, am I out of status  or L1 ?

 

2. Is it possible to aksing for consular processing instead of COS, while submitting the Response /

 

3. In this scenarios, does USCIS - gives a COS or consular Processing or reject H1 visa ?
