Will I be in Cap Gap

Hi ,

 

I got my H1 approved and got an RFE for my OPT extension and the last date for submission is after october

. Can I with draw my OPT before october and will I be in Cap Gap?

 

To work in Cap Gap should my employer be an everified company?

 

Please suggest.
