PERM Pending- NEXT STEPS

Hello Everyone,

 

I need your valuables inputs and suggestions.

 

1) Currently i am working with employer A . Emp A applied for my PERM during 5th year of H1B. 

2) my PERM appl was selected for random audit, EMp A sent reply and finally got denied. 

3) EMP A sent my PERM application to BALCA , STATUS is pending.

 

Questions:

 

1) Can my EMP A apply for a new PERM for a different position while old PERM is pending with BALCA. (My emp is telling me that he should first withdraw the first PERM which is peding with BALCA , to apply for a new PERM. is it TRUE.

2) can any toher EMP B start my PERM process with EMP A's PERM pending with BALCA. if EMP B PERM gets approved i will transfer to it....if it is denied , i will be with EMPA and wait for BALCA's PERM pending status,

1) True, you cant apply for new PERM with same employer till you withdraw BALCA application.

2) This is possible, EMp B can apply for PERM in parallel.
