philly_girl Posted August 5, 2013 Report Share Posted August 5, 2013 I have an H1-B stamp valid until August 2014. I was in India for the past 8 months and now we are moving back to the US. I have a job offer already and they are applying for a 3 year H1-B extension based on an approved un-revoked I-140. Once I get the I-797, can I just travel or do I need to stamp since the employer is different? If I do have to stamp, it will be simply visa renewal, is that correct? Link to comment

If your H1 visa is still valid and entering as h1 employee, then you don't need new visa. Link to comment
jairichi Posted August 5, 2013 Report Share Posted August 5, 2013 If you travel before expiry of stamped visa (Aug 2014) with a new approved I797 document you should be fine. Otherwise you have to go for a simple visa renewal Link to comment
philly_girl Posted August 6, 2013 Author Report Share Posted August 6, 2013 I am thinking of doing renewal anyways - just so I have the stamp for 3 years. So I can do renewal for upto a year before the visa expires? OR is it 1 year after the visa expires? Link to comment
