Hi,

 

I worked for the Company A in India.

 

I have approved H1B petiton with Company A and resigned my job from Company A. I didn't went for stamping with the approved petition in India.

 

The H1B petition was approved on July 2012.(last year quota 2012).

 

I would like to do H1b petition transfer with Company B which was located in USA.

 

I don't have my H1B approved petition copy with me. My company holds the approved copy. But i know the approved H1B petition receipt number.

 

Is it possible to file a new petition using the H1B approved petition receipt number alone.

 

Meanwhile, I have asked copy of my H1B approved petition in Company A. I don't know whether they will issue me a copy or not. 

 

The company B in USA attorney says "As we do not have any evidence of his H1b approval (new) it is going to be bit tricky.  We can try our best, but there is no guarantee it will work. Worst case you spend attorney fee and USCIS fee and will have nothing to show for.  Best case he gets an approval through VSII.". Please help me out to understand 

 

Please assist me on this.
