aamer87 Posted August 2, 2013 Report Posted August 2, 2013 Hi, I am on OPT until Oct '13 and have my H1b approved which is due to start on Oct 1st '13. I want to switch my employer. I see that the transfer is a possibility from one Employer to another before the Oct 1st date.However my concern is during the transfer process to my new employer and i give my current employer a 2 week notice, can my current employer REVOKE my H1b after the transfer of H1b has been initiated (and i am still waiting for my approved new transferred H1b) Please advise.
livliv Posted August 2, 2013 Report Posted August 2, 2013 Yes, they can do that, but it will not affect the second employer's petition. In any case, you can also join the second employer after their petition gets approved (not just filed). With premium processing decision can be obtained in 15 days.
jairichi Posted August 2, 2013 Report Posted August 2, 2013 By law, once you resign your current employer has to inform USCIS and revoke your H1B. But, this will not prevent any future employer from filing a H1B petition for you
