Prasadc Posted August 1, 2013 Report Posted August 1, 2013 Hi, I was in US for 3.5 years on L1 and left US on NOV 2011. My L1 visa vas got expired in the month of SEP 2011 and stayed 3 more months on my I94. Once I reached to India my current company immediately filed my H1 petition and got approved in 2012 OCT. I came to US on 6/24/2013 on H1B (stayed more 18 months in India before coming to US). In My H1 petition document it is also mentioned about my last L1 stay 3.5 years and requested H1 for remaining 2.5 years. Is this meaning my clock is not reset? Please let me know.
jairichi Posted August 2, 2013 Report Posted August 2, 2013 You have to stay a year outside US before a fresh cap subject H1B petition could be filed to get 6 years. Your employer had filed a H1B petition in April 2012 (before 1 year period). Therefore, it is a cap exempt H1B petition to get the remainder of 2.5 years
