My question is on how the visa transfer will happen from my current job(which is profit organisation) to the new job(non-profit organisation).If I would change my job, would my H1B transfer falls under H1B - cap extempt?I am really confused..please help... jairichi Posted July 31, 2013 Report Share Posted July 31, 2013 Your new employer has to file a new H1B petition for you. Once you get approval you can start working for new employer. Since you are already counted against cap it doesn't matter whether the job is cap exempt Link to comment
JoeF Posted August 1, 2013 Report Share Posted August 1, 2013 If you have been counted for the quota, you are not counted again until your 6 years are over. You can transfer without problems between for-profit and non-profit organizations. Link to comment
