H1B Transfer, receipt date & Old h1b Revoke

Hi,

 

  I am planning to get my H1b Transfered (i.e file a new h1b by company B) from Company A to B.

If I only get a Receipt date for H1b filing by company B, and company A revokes my visa before approval.

 

Will I be in status(just on receipt date)?

 

Also, some one told me that company A cannot revoke my approved I-140 if the approval time exceeded 1 year?

If your new H1b is filed before your Old H1b is revoked, you are fine in terms of status

till the time of decision is made on your new H1B.  Once the new H1B is approved

you have to act as per the new I-797 to maintain your status
