pharma499 Posted July 31, 2013 Report Posted July 31, 2013 I had been in the US for almost 2 year on h1b and after being out of status for a couple of months I returned to India in Feb of 2012. A company has offered to transfer my h1. Now that I have been outside the US for more than a year, will they require me to prove my status, that is ask for pay stubs to prove that I had maintained my status or will they forgive since I have been outside the country for more than a year. Please reply, as I have to make a decision wheter to proceed. JM
jairichi Posted July 31, 2013 Report Posted July 31, 2013 Well, you exited US after being out of status for 2 months. That will reflect in VO's system. Be ready to answer regarding this. Did you information your new employer/attorney about this out of status situation? If not, do inform them. Other than that if your and employer's credentials are good and you have all the required documents you should be fine.

My h1 was canceled only after leaving the USA, the company has given me an experience letter until the day I left USA. Its just that I was not payed for a while. Will this be reflected in ther system JM
jairichi Posted July 31, 2013 Report Posted July 31, 2013 I believe you should be ok then. If VO ask anything regarding that answer truthfully. But, in future always remember to leave the country immediately once you become out of status. Good luck with your visa interview.
