Immihelp1978 Posted July 30, 2013 Report Posted July 30, 2013 Hi, My postdoc contract at my univ. ends this sep 30th. 1. Is it possible to get a company to sponsor my h1b this year? 2. If another univ. wants to hire me, can they transfer the existing h1b? 3. Can I stay in the country assuming univ. no. 2 files for h1b paperwork even if approval doesn't come before sept. 30th? 4. If none of the above happen, how soon do I have to leave the country? My original contract on my current h1b was supposed to last until jan 31. Thanks!
jairichi Posted July 30, 2013 Report Posted July 30, 2013 Hi, My postdoc contract at my univ. ends this sep 30th. 1. Is it possible to get a company to sponsor my h1b this year? No. The cap has reached for this year. A company can file for you next year in April. 2. If another univ. wants to hire me, can they transfer the existing h1b? They have to file a H1B petition for you. 3. Can I stay in the country assuming univ. no. 2 files for h1b paperwork even if approval doesn't come before sept. 30th? You can stay. But, if for some reason your H1B gets denied you would be in trouble. Ask your employer to do PP. 4. If none of the above happen, how soon do I have to leave the country? My original contract on my current h1b was supposed to last until jan 31. The day your contract ends/payroll stops. If your original contract is till Jan 31 and if your employer is asking you to leave in Sep 2013 then your employer has to pay for your return ticket. Thanks!
jairichi Posted July 30, 2013 Report Posted July 30, 2013 H1B is over for this year...why not OPT? Unfortunately there is no OPT for a postdoc
