pksaini Posted July 26, 2013 Report Share Posted July 26, 2013 I am working for an IT company in India. The H1B Petition filed by my Employer and I received I-979B with validity till October 2012. I didn't went for any VISA Stamping during this duration. Now, I have changed my Employer also and the validity of I979NB is also expired. I have two questions: - Will I (or my new Employer) can extend the I979B Validity. - Can the old H1B Petition be used any ways OR I need to file a new H1B Petition. Thanks in Advance. Link to comment
jairichi Posted July 26, 2013 Report Share Posted July 26, 2013 Your new employer has to file a new H1B petition. Since you are already counted under cap the new petition is cap exempted. Once that is approved, take your new I797 and get a H1B stamped to your passport to travel to US Link to comment
