I-140 Approved, can I use my expired h1-b after the gap of 3 years

I worked in USA from 2008 to 2010 in h1-b visa, and I had come back to India for some personal problems, h1 was expired on Oct 2010. I-140 got approved in 2011 which was applied in 2010, and now I am working in India now. And my question is can my employer do extension on the same H1-b petition now. Will there be any status change on my h1 petition, will that affect my petition when my employer try to renew it, and will I be cap exempt. Or he has to go for a new h1? Kindly let me know.
