Will I be able to get new H1b petition approved?

I am outside US now.

 

My old H1 Visa(Company A) has expired.

 

I hold a new H1 petition(Company B) which is valid untill 2015. I have been to Visa interview where my application was put on Admin processing. I have been waiting since 6 months. No update till now. I dont want to run behind it anymore.

 

I moved to a new company(Company C) now. Can I get a new H1 petition(Quota Exempt) with this company? I dont have valid visa - Will it effect the approval of new petition?

Yes, you can.

Your new employer C can file a new H1B petition. But, I believe you have to withdraw your earlier H1B petition done through your previous employer B.
