What happens if H1 RFE is not responded

Hi,

 

I am Currently in F2 Status and my Employer has applied for H1 (2013) and my application is picked in the lottery.

 

My employer has informed me that he received 3rd RFE for my H1 application and after days of multiple discussions now he is opting not to Answer the RFE (RFE asking for TAX forms and some other stuff which cannot be provided by my employer), 

 

1. How will this effect my Future H1 Applications (Next Year-2014)

2. What is the best option - either NOT to respond or ask the Employer to Withdraw my application ?

3. Can i apply for F1 Change of Status ? Will this H1 Application effect my chances of getting the F1 ?

 

 

Please advice what are my best options, Any help is greatly appreciated

2. It's better to withdraw the app

3. Your F1 chances are low since you have already file for H1 to work in US.
