vpknox Posted July 16, 2013 Report Share Posted July 16, 2013 My H1-B will be revoked this friday July 19. I have only one option in this short time to stay on status is to change to B2 visa. I have the following questions regarding my conversion. 1. I will be legally authorized to stay in US once I recieve my recipt which will be couple of days after I send my B2 application? 2. Can I cahnge back to H1 B Visa after applying for B2 if I find an employer in a week after that is willing to sponsor me? (during B2 is pending or do I have to wait untill B2 is approved). 3. How long it takes to convert back to H1B Visa? (Can I apply by premium?). I am trying to do legal by not getting in to any sort of problems. Please guide me through based on all your experience. metroguy Posted July 29, 2013 Report Share Posted July 29, 2013 If you have a paystub till july 15th, then you have 15 more days to look for a new job... Start looking for a job early and apply for h1b transfer. In the wort case they approve ur h1b with out change of status and you have to go back to ur home country to get a new visa stamp. The OP is out of status from the day of layoff. When the last paycheck was or when the H1 was revoked is completely irrelevant. The OP should have immediately upon layoff filed a COS to B2.
