roxx19 Posted July 15, 2013 Report Share Posted July 15, 2013 I had H1B approval for 3 years. Thing is that I had applied LCA for say AB state, ie my employer located at that AB state. I had applied this April 2013. and then I got the new job in different state say CD state. and joining was on 4th April 2013. and now Planning to go India or Canada for VISA stamp in month of October 2013. Here I need to file Amendment due to change of state. Now LCA is filed for CD state where my location is and got LCA approved. H1B application submitted with LCA was AB state on 1st April. Then i had changed the state and started working in client location CD state. H1B got approved without client letter. But now I am different state, need to file amendment for that. So i need to know when is the right time to file amendment? Please help me out as I need to go Canada or India in month of October for stamping. I can file amendment as of now like in month of August or Sept ???? OR i need to file amendment after the H1B start date ie 1st Oct ???? I need to get Amendment Approval. Clarify the above clearly. if you are going to use H1 for the first time from the period of Oct 1 2013. Generally Amendment is something if you apply the start date reflects on it from the time of approval itself. But in your case looks like you need to wait until oct and make a premium if you are in hurry. Anyways check with your employer and attorney in detail for this. Link to comment

I got new offer (at Location CD) before stamping and can I now apply for new LCA at CD and H1B Amendment (to change client from X at AB to client Y at CD) and proceed for the Visa stamping?
