Suimma Posted July 12, 2013 Report Share Posted July 12, 2013 HI, I came to US on H4, converted to F1 and currently on OPT. I am planning for India trip in Aug. But STEM OPT is still in initial review. Planning to come back to US on H4. Do I need to convert to H4 in US and go for stamping or can I directly go for H4 stamping in India? Link to comment
Attorney_11 Posted July 12, 2013 Report Share Posted July 12, 2013 Assuming that the principal H1B noncitizen spouse or parent is validly present in the United States maintaining H1B status, an individual does not have to seek COS to H4 status prior to departing the United States to apply for a H-4 visa at a US Consulate or Embassy abroad. livliv Posted July 15, 2013 Report Share Posted July 15, 2013 If you return in H4 status, your OPT will end. You need to obtain F1 Visa and return in F1 status. Link to comment
